Terms & Conditions

By booking a vehicle with Fuji Top Down ("we," "us," or "our"), you agree to the following Terms and Conditions.

1. Reservation & Cancellation

Cancellation
 

  • Free cancellation up to 48 hours before your pickup time

  • 50% cancellation fee for cancellations made 24-48 hours before pickup

  • No refund for cancellations made within 24 hours of pickup, or for no-shows

  • Cancellations you make due to weather conditions are subject to the policy above, unless we determine that the weather makes handover or operation of the vehicle unsafe (see "Cancellation by Us" below)

Cancellation by Us  In the rare event that we must cancel your reservation due to severe weather (e.g., heavy snow, typhoon, road closures) or other unforeseen circumstances that make the rental unsafe or impossible, a full refund will be issued.
 

How to Cancel  Cancellations must be submitted in writing via email or messaging app (e.g., WhatsApp). The cancellation date is the date and time on which we receive your written notice.

 

All times are Japan Standard Time (JST, UTC+9). The 48-hour and 24-hour periods above are counted back from your scheduled pickup time, which is also Japan Standard Time.

Refunds Refunds are issued to the credit card used for payment, within 7 days.

2. Driver Requirements

To rent a vehicle, the driver must:
 

  • Be at least 18 years old, and have held a valid driver's license for at least 1 year

  • Present one of the following at pickup:

  1. A valid driver's license issued by a Public Safety Commission in Japan

  2. An International Driving Permit issued under the 1949 Geneva Convention on Road Traffic, together with your passport

  3. A driver's license issued in Switzerland, Germany, France, Taiwan, Belgium, or Monaco, accompanied by an official Japanese translation

If your license was not issued in one of the countries/regions listed above, you must obtain an International Driving Permit before your rental — a home-country license alone, without an IDP, cannot be accepted.
 

IMPORTANT: If you cannot present a valid license at pickup, we are unable to rent you a vehicle. In this case, only 50% of the amount paid will be refunded.
 

Multiple Drivers If more than one person may drive during the rental, all potential drivers must be registered at pickup. Each additional driver must present their own documents (driver's license, and passport / International Driving Permit if applicable).
 

IMPORTANT: Only drivers registered at pickup are permitted to drive. If an unregistered driver operates the vehicle and is involved in an accident, insurance and compensation coverage will not apply, and the customer will be fully responsible for all resulting costs.

3. Vehicle Handover & Return

We inspect the vehicle before handover, and ask that you check it together with us and confirm its condition before you drive off.
 

Please return the vehicle in the same condition as at handover, allowing for normal wear.
 

Please return the vehicle with a full tank of fuel. If the tank is not full at return, a ¥6,000 refueling fee will apply.
 

Please check the vehicle for any personal belongings before returning it — we are not responsible for items left behind after return.

 

If you rented an ETC card, please remove it from the reader and return it with the vehicle (see Section 8).

A dashcam is installed in the vehicle for safety and accident-verification purposes. By using the vehicle, you agree to being recorded while driving. Recordings are used only to review accidents or incidents, or if requested by the relevant authorities.

4. Vehicle Use — Prohibited Actions

While renting the vehicle, you may not:
 

  • Use the vehicle for commercial purposes (e.g., paid transport of passengers or goods) without our approval

  • Let anyone drive who was not registered with us at pickup

  • Sublet, transfer, or use the vehicle as collateral

  • Alter the vehicle or its number plates

  • Drive on a circuit, race track, or use the vehicle for racing or time attacks

  • Use the vehicle to tow or push another vehicle

  • Take the vehicle outside Japan

  • Drive on unpaved roads, beaches, riverbeds, or snow-covered roads without proper winter tires or chains

  • Smoke in the vehicle (including e-cigarettes)

  • Bring pets into the vehicle

  • Open or close the soft top while driving, or drive with the top down in strong wind or rain

  • Do anything likely to damage the soft top or other parts of the vehicle

  • Break Japanese traffic laws — this applies even if driving customs differ in your home country

5. Breakdown, Accidents & Theft

If the vehicle breaks down or you notice a fault, stop driving immediately, contact us, and follow our instructions.
 

If you are involved in an accident, stop immediately, take any steps required by law (including contacting police), then contact us right away and follow our instructions. Please cooperate with our insurance company's investigation and do not agree to any settlement with the other party without our approval.
 

If the vehicle is stolen, contact the police immediately, then contact us.

6. Insurance & Liability

Even where insurance covers a claim in full, a separate Non-Operation Charge (see below) may still apply while the vehicle is out of service.
 

While you are renting the vehicle, our insurance covers:
 

  • Bodily injury to others: unlimited

  • Property damage to others: unlimited, no deductible

  • Damage to the vehicle: up to ¥1,000,000, no deductible

  • Injury to passengers: up to ¥50,000,000 per person
     

Damage or loss not covered by this insurance, or exceeding these limits, is the customer's responsibility.
 

Non-Operation Charge (NOC) If the vehicle cannot be used for business due to an accident, damage, or soiling during your rental, a Non-Operation Charge applies in addition to any repair costs:
 

  • ¥20,000 if the vehicle can be returned under its own power

  • ¥50,000 if towing is required
     

IMPORTANT: Insurance will not apply if the vehicle is driven by anyone who was not registered with us at pickup (see "Multiple Drivers" above).

7. Payment

Full payment is required in advance to confirm your reservation. Payment is processed securely via Square.

8. ETC Card & Tolls

¥1,000 per rental, tax included. The card may be used only in the vehicle you rented, and must be returned with it; if it is not returned, a replacement fee applies. Tolls are yours to pay, settled by credit card at return — or charged to your registered card afterwards if the amount is not yet available when you hand the car back.

9. Personal Information

We collect your (and any additional driver's) name, license details, and — for overseas customers — passport information, in order to meet Japanese rental car regulations, verify your identity, and respond appropriately in the event of an accident, theft, or traffic violation.

10. Governing Law

These Terms and Conditions are governed by the laws of Japan. Any disputes will be subject to the jurisdiction of the summary court with authority over our place of business.
 

These English Terms and Conditions are a translation of our official Japanese Rental Agreement (貸渡約款). In the event of any discrepancy between the two, the Japanese Rental Agreement shall govern.

11. Limitation of Liability

To the extent permitted by Japanese law, our liability arising from your rental is limited to the insurance coverage set out in Section 6. We are not liable for indirect, incidental, or consequential losses (such as lost travel time, missed connections, or lost income), except where such loss results from our willful misconduct or gross negligence.

12. Force Majeure

Neither party is liable for delay or failure to perform any obligation under these Terms and Conditions where such delay or failure results from circumstances beyond that party's reasonable control, including but not limited to natural disasters, extreme weather, government action, or road closures.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The version in effect at the time of your reservation will apply to that rental. The current version is always available on our website.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable under Japanese law, the remaining provisions will continue in full force and effect.
