Chapter 1 General Provisions
Article 1 (Application of this Rental Agreement)
-
The Lessor shall rent out the rental vehicle (hereinafter the "Rental Vehicle") to the Renter, and the Renter shall rent it, in accordance with the provisions of this Rental Agreement.
-
Matters not provided for in this Rental Agreement shall be governed by laws and regulations or by general practice.
-
The Lessor may agree to special provisions to the extent that they do not conflict with the purpose of this Rental Agreement, with laws and regulations, with administrative directives or with general practice. Where a special provision has been agreed, that special provision shall prevail over this Rental Agreement.
Chapter 2 Reservations
Article 2 (Application for a reservation)
-
When renting a Rental Vehicle, the Renter may apply for a reservation, having agreed to this Rental Agreement and to the separately established rate table and other documents, by the method separately prescribed, specifying in advance the vehicle model, the date and time on which the rental is to begin, the place of pick-up, the rental period, the place of return, the driver and the other conditions of the rental (hereinafter the "Rental Conditions").
-
Where an application for a reservation is made by the Renter, the Lessor shall, in principle, accept the reservation within the range of the Rental Vehicles held by the Lessor. In this case, the Renter shall pay the reservation deposit separately prescribed, except where the Lessor specifically permits otherwise.
-
The Lessor may receive all or part of the rental charges as the reservation deposit at the time of the application for a reservation. In this case, the reservation deposit shall be applied to the rental charges when the Rental Contract is concluded.
Article 3 (Change of a reservation)
Where the Renter intends to change the Rental Conditions referred to in Paragraph 1 of the preceding Article, the Renter shall obtain the Lessor's prior consent.
Article 4 (Cancellation of a reservation, etc.)
-
The Renter may cancel a reservation by the method separately prescribed.
-
Where the Renter, for reasons attributable to the Renter, has not commenced the procedures for concluding the rental contract for the Rental Vehicle (hereinafter the "Rental Contract") within one hour after the reserved rental start time, the reservation shall be deemed to have been cancelled.
-
In the cases referred to in the preceding two paragraphs, the Renter shall pay the Lessor a reservation cancellation fee as separately prescribed. In this case, the Lessor shall refund to the Renter the balance of the reservation deposit received after deducting the reservation cancellation fee. This shall not apply where Article 7, Paragraph 3 applies.
-
Where a reservation is cancelled, or a Rental Contract is not concluded, for reasons attributable to the Lessor, the Lessor shall refund the reservation deposit received and shall in addition pay a penalty as separately prescribed.
-
Where a Rental Contract is not concluded owing to an accident, theft, failure to return, a recall, a natural disaster or any other cause attributable to neither the Renter nor the Lessor, the reservation shall be deemed to have been cancelled. In this case, the Lessor shall refund the reservation deposit received.
Article 5 (Substitute Rental Vehicle)
-
Where the Lessor is unable to rent out the Rental Vehicle reserved by the Renter, the Lessor may offer to rent out a substitute Rental Vehicle. However, because the Lessor holds only a small number of Rental Vehicles, there are cases in which a substitute Rental Vehicle cannot be provided.
-
Where the Renter accepts the offer referred to in the preceding paragraph, the Lessor shall rent out the substitute Rental Vehicle on the same Rental Conditions as at the time of the reservation, except for the vehicle model.
-
The Renter may refuse the offer of a substitute Rental Vehicle referred to in Paragraph 1 and cancel the reservation.
-
In the case of the preceding paragraph, where the cause of the inability to rent out under Paragraph 1 is attributable to the Lessor, the matter shall be treated as a cancellation of the reservation under Article 4, Paragraph 4, and the Lessor shall refund the reservation deposit received and shall in addition pay a penalty as separately prescribed.
-
In the case of Paragraph 3, where the cause of the inability to rent out under Paragraph 1 is not attributable to the Lessor, the matter shall be treated as a cancellation of the reservation under Article 4, Paragraph 5, and the Lessor shall refund the reservation deposit received.
Article 6 (Exemption)
The Lessor and the Renter shall make no claim against each other in respect of the cancellation of a reservation or the failure to conclude a Rental Contract, except in the cases provided for in Articles 4 and 5.
Article 7 (Reservations handled by agents)
-
The Renter may apply for a reservation at a travel agency, an online travel agency (OTA), an affiliated company or any other party that handles reservation business on behalf of the Lessor (hereinafter an "Agent").
-
A Renter who has made an application referred to in the preceding paragraph to an Agent may apply to change or cancel the reservation only to that Agent.
-
Where an application for a reservation has been made through an Agent, the collection of the rental charges and the handling of fees and refunds relating to changes and cancellations of the reservation shall be governed by the conditions presented to the Renter by that Agent.
-
In the case of the preceding paragraph, the Lessor may not collect the rental charges directly from the Renter.

-
The Renter shall specify the Rental Conditions provided for in Article 2, Paragraph 1, and the Lessor shall specify the rental conditions by means of this Rental Agreement, the rate table and other documents, and the Rental Contract shall be concluded accordingly. -
In the cases referred to in the preceding two paragraphs, where a reservation has already been established with the Renter, the matter shall be treated as a cancellation of the reservation, and where a reservation cancellation fee has been received from the Renter, the reservation deposit received shall be refunded to the Renter. In this case, the Lessor shall refund to the Renter the balance of the reservation deposit received after deducting the reservation cancellation fee. This shall not apply where Article 7, Paragraph 3 applies.
-
In the case of the main text of the preceding paragraph, where the Rental Contract could not be concluded because the Renter or the Driver fell under Item 1 or Item 2 of Paragraph 1, the reservation cancellation fee shall be 100 per cent of the rental charges.
