Fuji Top Down (“we,” “us,” or “our”) operates the website https://www.fujitopdown.com/ (the “Site”) and provides convertible car rental and related services (the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our Site or Services.​

1. Information We Collect

We may collect the following types of information:
 

A. Information you provide to us

  • Contact details (e.g., name, email address, phone number)

  • Booking and inquiry details (e.g., rental dates, preferences, messages)
     

We do not ask you to submit passport numbers or driver’s license numbers through our Site’s booking or inquiry forms. We check these documents in person when you collect the vehicle — see Section 1C below.

B. Information collected automatically

  • Device and browser information

  • IP address and approximate location (derived from IP)

  • Site usage data (pages viewed, clicks, referring pages)

  • Cookies and similar technologies (see Section 6)

C. Collected when you pick up and use the vehicle

Japanese law requires us to keep a rental register and issue a rental certificate for every rental. To do this, we record the driver's name, address, licence type and licence number, and we take a copy of the driver's license.
 

Where the licence was issued outside Japan, we also take a copy of the passport. We use it to confirm your identity and your date of entry into Japan — an International Driving Permit is valid for one year from that date, so we need to check it before we can release the vehicle.
 

We also collect a mobile phone number so that we can reach the driver during the rental period.
 

Our vehicles are fitted with a dashcam, which records while the vehicle is in use. The recording may also include location, speed and time data. The recording stays on a memory card in the vehicle; we cannot see it remotely, and we do not track vehicles in real time.
 

2. How We Use Your Information

We use your information to:
 

  • Provide and manage bookings and customer support

  • Respond to inquiries and communicate about your reservation

  • Prevent fraud and protect the security of our Site and customers

  • Improve our Site and Services (analytics, troubleshooting, performance)

  • Send service-related messages (e.g., booking confirmations, updates)

  • Send marketing communications where permitted by law (you can opt out anytime)

  • Meet our obligations under the Road Transportation Act and the conditions of our rental business license, including keeping the rental register and issuing the rental certificate

  • Confirm the driver's identity and eligibility to drive in Japan

  • Contact the driver during the rental period

  • Establish the facts of an accident, damage, theft or traffic violation, and to handle the resulting insurance claim​

3. Legal Bases for Processing (Where Applicable)

Depending on your location and applicable law, we process personal information based on:
 

  • Performance of a contract (to provide the Services you request)

  • Legitimate interests (e.g., improving services, preventing fraud, ensuring security, and establishing the facts of an accident or incident from dashcam recordings)

  • Consent (e.g., certain cookies or marketing communications)

  • Legal obligations (e.g., record-keeping requirements)

4. How We Share Your Information

We may share your information with:

  • Service providers  who help us operate the Site and Services (e.g., website hosting, analytics, email communications)

  • Payment processors (only if/when you make a payment through the Site)

  • Legal and safety authorities  if required by law or to protect rights, safety, and prevent fraud

  • The police and the Public Safety Commission  if a parking violation is recorded against one of our vehicles, we are required to identify the driver. We may provide the police and the Public Safety Commission with the rental certificate and related documents, as set out in Article 18 of our Rental Agreement.

  • Our insurer and its investigators  where a claim arises.

  • Other rental car operators  If an unpaid parking penalty or a failure to return a vehicle occurs, the driver's name, date of birth and licence number may be used by rental car operators when assessing future rental applications, as set out in Article 33 of our Rental Agreement.

5. Data Retention

We keep personal information only as long as necessary for the purposes described in this policy, including to provide Services, comply with legal obligations, resolve disputes, and enforce agreements. Booking, contract, and payment records are retained for up to seven (7) years in accordance with Japanese tax and bookkeeping regulations.

The rental register is kept for two years, as required by the conditions of our rental business license. Copies of driving licences and passports are kept for the same period and are then destroyed.

Dashcam recordings are overwritten automatically in the normal course of operation. Where an accident or incident occurs, the relevant recording is retained until the matter and any insurance claim are resolved.

6. Cookies and Similar Technologies

We use cookies and similar technologies to:

  • Enable core site functionality

  • Understand how visitors use the Site (analytics)

  • Improve performance and user experience

You can control cookies through your browser settings. If we use a cookie consent banner, you can manage your preferences there as well.

7. Analytics (Google Analytics)

We use Google Analytics to understand how visitors use our Site and to improve our Services. Google Analytics may collect information such as your IP address, device and browser information, and usage data (pages viewed, time spent, and interactions). This information may be processed by Google in accordance with Google’s policies.

8. Your Rights

Depending on your location and applicable law, you may have rights to:
 

  • Access the personal information we hold about you

  • Request correction or deletion

  • Object to or restrict certain processing

  • Withdraw consent (where processing is based on consent)

  • Request a copy of your information (data portability)
     

Some of the records described above are kept because Japanese law requires it. While a legal retention period applies, we cannot delete those records at your request.

If you are a California resident, you have the right to know what personal information we collect and to opt out of any “sale” of personal information. We do not sell your personal information.

If you are a resident of the EU or UK and are not satisfied with our response, you have the right to lodge a complaint with your local data protection authority.​

9. International Transfers

Your information may be processed in countries other than your own, including where our service providers operate. We take reasonable steps to protect your information in accordance with applicable laws. We are based in Japan. The European Commission has recognized Japan as providing an adequate level of data protection under the GDPR, allowing personal data to be transferred from the EU to Japan without additional safeguards.

10. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure.
